PRIVACY POLICY AND PERSONAL DATA PROCESSING AGREEMENT

1. General Provisions

1.1. The present Privacy Policy and Personal Data Processing Agreement (hereinafter, "the Policy") applies to the full scope of the information about the User that Individual Entrepreneur David Saltkhutsishvili may obtain in the process of the User's use of Individual Entrepreneur David Saltkhutsishvili's https://darkroomstore.com/ website. The fact of the User's use of the Website and/or the Forms signifies the User's unconditional acceptance of the Policy and the terms and conditions of personal data processing stipulated herein; in the event if the User does not accept any of the terms, he or she shall refrain from the use of the Website and the Forms.

2. Terms and Definitions

2.1. Individual Entrepreneur David Saltkhutsishvili (hereinafter, "the Organization"): the personal data controller, registered as an individual entrepreneur under the current legislation of the Russian Federation. 2.2. The User: a legally capable individual who is visiting or has visited the Website.

2.5. 2.6. 3. Purposes of Personal Data Collection and Processing

- to perform other actions with the purpose of delivery of goods and services to the User.

3.3. Due to the used methods of personal data collection, the Organization does not verify accuracy of the Personal Data provided by the User and does not monitor its relevance. However, the Organization assumes that the User provides accurate Personal Data. The User shall bear the full scope of responsibility and deal with potential implications of providing inaccurate or outdated Personal Data.

3.4. The User has been warned that, during his or her visit to the Website and the downloading of available information, the Website automatically collects information about the User for statistical purposes (with the use of HTTP cookies). The Website collects the User's IP address, type of browser and operating system, date and time of visit, and other data for statistical purposes. This information is regarded as publicly accessible. The administrators of the Website shall not be held responsible or liable for its disclosure. No personal data about Website Users (i.e., surname, name, patronymic, address, telephone number, email address, etc.) is collected automatically.

4. Terms an Conditions of Personal Data Processing

4.1. The User's Personal data shall be treated as confidential; it may not be disclosed, transferred, or provided to third parties without the User's consent; it is not regarded as publicly accessible and shall be used exclusively for the purposes specified herein and/or for the conclusion of an agreement with the User.

The Personal Data provided by the User may be transferred to the courier and/or the delivery service and/or the postal service directly responsible for the delivery of the ordered goods in the event if the User has ordered delivery of the goods.

Provision of the User's Personal Data to agents and third parties operating under a contract with the Organization with the purpose of meeting its obligations to the User – the personal data subject – shall not be considered a breach hereof.

The Organization shall process the User's details and Personal Data as well as the data stored on the servers specified in Clause 4.3 of the Privacy Policy, which includes use of the data, its verification, and erasure (with regard to each of the Personal Data subjects), with mandatory participation of an employee of the Organization.

The User's Personal Data shall remain confidential except for cases when the User willfully grants public access to such information to an unlimited number of individuals.

4.2. The Organization protects the User's Personal Data in accordance with the requirements to the security of such information and undertakes to select such protection methods that ensure adequate security of such information.

4.3. To protect the User's Personal Data, to ensure its proper use, and to prevent unsanctioned and/or accidental access to it, the Organization shall take necessary and adequate technical and administrative measures. The Personal Data provided by the User shall be stored on servers with restricted access rights.

4.4. The Organization may use the information provided by the User, including his or her Personal Data, to ensure compliance with the existing legislation of the Russian Federation (including cases of prevention and/or suppression of illegal and/or unlawful actions of the Users). The information provided by the User may be disclosed only under the existing legislation of the Russian Federation by order of the court or law enforcement agencies and in a number of other cases provided for by the existing legislation of the Russian Federation.

4.5. The legitimate grounds for the processing of Personal Data are Art. 24 of the Constitution of the Russian Federation, Federal Law No. 152-FZ On Personal Data, and the User's consent to the processing of his or her personal data.

4.6. The User accepts that all the materials and services of the Website or any part of them may be accompanied by advertising. The User acknowledges that the Organization shall not be held responsible or liable for such advertising.

4.7. The Organization does not process or store personal data about the User's payment cards used for payment during the Order checkout.

4.8. The Organization shall not be held responsible for the information provided by the User at his or her own discretion in a publicly accessible form on the Website in the event if the Website offers such functionality.

5. Confirmation of Consent

5.1. The User may refuse to fill out the Forms or provide his or her Personal Data if any of the terms or conditions set out herein are unacceptable for the User.

5.2. 5.3. The User's acceptance of the terms and conditions hereof, including the procedure of personal information processing, is indefinite.

5.4. The User's consent to the processing of his or her personal data extends to both automatic and non-automatic methods.

5.5. The User has been warned that the Organization shall not be held responsible for external resources that the User may visit or use by following the links presented on the Website. Information presented on external websites that may be linked to the Website is not regarded as an extension of this Website.

6. Privacy Policy Amendment

6.1. The Organization reserves the right to amend the present Privacy Policy at any time. When amendments are made, the updated version shall contain the date of the latest update. The new version of the Policy shall come into force at the moment of its publication unless the new version of the Policy states otherwise. The current version shall be available at the present Website https://darkroomstore.com/ at any time.

6.2. The amendments referred to in Clause 6.1 shall come into force on the next consecutive day after the publication of new version of the Privacy Policy on the Website. In the event if the User does not accept the new amendments, he or she shall refrain from accessing the Website and cease to use the materials and services thereof.

6.3. The User may revoke his or her consent fully or partially at any time by sending a written request to the Organization at the mailing address of the Organization specified in Clause 2.1 hereof. The Organization shall cease to process the User's Personal Data upon receipt of such request.

6.4. In the event if a provision of the Policy is deemed invalid or liable for compulsory execution by a court ruling, the remaining provisions hereof shall remain valid.
